1. General Purpose and Functionality

Laria is an AI-driven platform that enables customers to create user-generated content (UGC)-style advertisements within minutes. The platform uses the following AI models and services:

• ElevenLabs
• OpenAI
• LipDub AI

2. Data Protection and GDPR Compliance

Legal Basis The processing of personal data is based on contractual agreements pursuant to Art. 6(1)(f) GDPR. Paia Intelligence GmbH, the company behind Laria, ensures compliance with all data protection regulations applicable to it as a controller under the GDPR.

• All uploaded content remains the property and responsibility of the customer
• Customers are responsible for ensuring that all uploaded or entered data complies with data protection laws
• A data processing agreement (DPA) according to Art. 28 GDPR will be concluded if personal data is processed
• We ensure the protection of data subject rights, including the right to access and delete personal data, even for AI-generated profiles

3. Copyright and Usage Rights

Copyright Ownership According to current copyright law, AI models themselves cannot be authors. Generally, AI-generated content is considered public domain unless it results from creative and specific user input. In such cases, the customer becomes the copyright holder.

• All avatars and content provided by Paia Intelligence GmbH are properly licensed and sublicensed to customers under specific terms outlined in our Terms of Service
• Customers receive a non-exclusive, worldwide right to use the generated content after full payment
• The content may be synchronized, combined with other content, advertised, publicly performed, streamed, or downloaded
• For commercial advertising content, usage is limited to six months unless otherwise agreed
• Customers are solely responsible for ensuring that their use of generated content does not infringe upon third-party intellectual property or trademark rights

4. Personal Rights and Use of Likeness

Consent for Likeness Use No realistic depictions of real persons, celebrities, or testimonials are created without prior written consent.

• Illegal, obscene, defamatory, offensive, or discriminatory content
• Erotic or pornographic content
• Political, religious, or ideological content
• Content related to alcohol, tobacco, drugs, weapons, gambling, escort services, or matchmaking services

5. Liability and Responsibility

Limited Liability Paia Intelligence GmbH excludes liability except in cases of gross negligence or intent, or for damages resulting from injury to life, body, or health.

• Customers are responsible for the compliance of the content they generate and publish
• They must ensure compliance with any applicable labeling obligations, particularly when publishing advertising content generated via AI
• Customers indemnify Paia Intelligence GmbH against any third-party claims arising from legal violations

6. Transparency and AI Use

Disclosure of AI Usage While currently no general legal obligation exists to label AI-generated content, Laria provides the option to indicate that a piece of content was created using AI. Customers bear the responsibility for transparency towards their own end-users.

7. Regulatory Compliance and Risk Management

Monitoring Legal Developments Paia Intelligence GmbH proactively adapts to new regulatory requirements, including the EU AI Act.

• Risk assessments, including Data Protection Impact Assessments (DPIAs), are conducted as required by GDPR obligations
• Auditability and traceability mechanisms for AI decision processes are in place where necessary
